Many studies exist on the connection between cow’s milk-based infant formula or milk fortifiers and the increased risk in premature or low birth weight infants developing Necrotizing Enterocolitis, commonly referred to as “NEC.”
Similac and Enfamil are two of the leading brands of cow’s milk-based formula. Other known brands include Earth’s Best, Happy Baby, Go & Grow, Gerber, Parent’s Choice, Baby’s Only, Loulouka, Holle, Kendamil, Bobbie, and Lebenswert.
Types of injuries associated with NEC may include intolerance to formula, bloated or swollen abdomen, bloody stools, jaundice, vomiting a greenish-yellow liquid, trouble breathing, and a dangerously low heart rate. Studies reveal that many infants who suffered from NEC were never diagnosed, as their complications were assumed to be the result of their preemie status.

Necrotizing Enterocolitis (NEC) is a serious gastrointestinal problem that mostly affects premature infants. NEC causes inflammation in the intestinal tissue, causing it to die.
A perforation or hole may form in your infant’s intestine, allowing bacteria to leak into the abdomen or bloodstream through the hole. NEC usually develops within two to six weeks after birth and can range in severity from mild to life-threatening. In many NEC baby formula cases, the infant required surgery to manage NEC. Sadly, some cases of NEC resulted in death.
In 2019, a review of all available literature from clinical trials that compared formula versus donor breast milk for feeding preterm or low birth weight infants (which involved 1,871 infants) found that preterm infants given cow’s milk-based formula nearly doubles their risk of developing NEC.
Parents whose premature babies were given cow’s milk-based formula or a milk-based fortifier and developed NEC have a right to bring a product liability lawsuit against the manufacturer of the product.
You may qualify for compensation through a baby formula lawsuit if your baby:
Many product liability lawsuits have already been filed against Mead Johnson Nutrition Company, the manufacturer of the following products:
Other product liability lawsuits have been filed against Abbott Laboratories, the manufacturer of the following products:
